General Terms & Conditions for TOA Klub Ticket Purchase with Tech Open GmbH

I. – II. Scope, object and formation of the contract

The following General Terms and Conditions (T&Cs) shall exclusively govern the contractual relationship between Tech Open GmbH, represented by its Founder Nikolas Woischnik, Prenzlauer Allee 242, 10405, Berlin, hereinafter referred to as the “Organiser”, and the customer.

These T&Cs shall apply exclusively. Terms and conditions of the customer which contradict with or depart from these T&Cs shall not be deemed incorporated into the contract.

The object of the contract shall be the sale of tickets by the Organiser to the customer for the specific TOA Klub program advertised in each case.

The customer may only buy tickets for the event from the Organiser’s website. A valid contract is formed between the parties at such time as the order process is completed and full payment for the tickets is made.

Formation of contract takes place in German only. The German language version of these T&Cs shall always control in the event of ambiguities.

Tickets grant the customer access to the TOA Klub program for the duration of the program. 

III. Performance of the contract

Tickets can only be purchased via our website www.toaklub.com The purchase is conducted by our cooperation partner Paperform, Law Squared Level 19, 114 William Street Melbourne VIC 3000 Australia. The contract with the customer remains Tech Open GmbH.

The purchase price shall fall due for payment at such time as the tickets are ordered. The customer shall choose between different payment methods, namely Credit Card (Visa, Master Card, American Express), direct debit and direct transfer (“Sofortüberweisung”).

Following receipt of payment in full by the Organiser, the Organiser shall forward the tickets to the customer at his specified email address. The customer shall receive no additional tickets by post or fax. The customer shall be solely responsible for safe-guarding the tickets 

Ticket prices are final and in Euro with additions of VAT and processing fees. The amount of the price refers to the current prices on our website. The final price is shown to the customer before completing the purchase.

IV. Rights and obligations

Customers are obliged to check received tickets for errors regarding price, date and program name. 

Objections are to be made as soon as possible, latest 3 days after receiving the ticket. They can be made via email to hihello@toaberlin.com or via post to Post an Tech Open GmbH, Prenzlauer Allee 242, 10405 Köpenicker Chaussee 3a, 10317, Berlin.

The Organiser shall have the right to alter the content (incl. speakers/mentors) as well as duration of programs  at short notice. The Organiser shall source an equivalent substitute, if possible. This shall not give rise to any right on the part of the customer to rescind the contract and/or cancel the ticket.

Tickets are not transferable to another person. 

The parties agree that TOA Klub is a global learning and networking program which lives on the names of its participants. Appropriate to this fact the Organiser is allowed to publish attendance information such as the customer’s name and company or to forward this data to third parties.

Tickets are to be kept safely in order not to be reproduced by third parties. In case of loss and/or improper use of the ticket, customers cannot claim access to the program or reimbursement of the ticket price.

V. Refunds 

We grant refunds of the full ticket price without giving any reason until four weeks before the start of the program. After that, customers can claim refunds only in case of a date change or cancellation of the TOA Klub program from the Organiser’s side. 

Ticket redemption does not apply unless for reasons mentioned above. No replacement is offered in case of loss.

VI. Resale, contract penalty

Tickets can only be purchased for personal use. Purchase for profitable repurchase (commercial use) is prohibited. 

Every customer who resells a ticket in an unauthorized way has to pay a contract penalty for each ticket sold to Tech Open GmbH. The individual amount of the penalty is to be settled at discretion of the organiser.

The organiser also has the right to revoke access to the program in case of but not limited to the entrainment of forbidden objects, an obvious alcoholised or intoxicated state or a violation of the Conduct Policy. In those cases tickets lose their validity, the prices will not be reimbursed.

VII. Photographs and recordings

Abidance at the event is at the customer’s own risk.

The customer hereby expressly confirms his agreement that the Organiser shall have the right to take photographs/screenshots or make recordings of the customer before and during the entire event, and to publish, disseminate and circulate the same on the Internet, in print media and other media.

The commercial use of own photos and footage taken at the venue of Tech Open Air requires agreement by the organiser.

VIII. Use of materials 

The customer agrees to respect intellectual property rights. Materials provided by the Organizer, other Users or speakers and mentors are only for personal use. Screenshots and/or image/video recordings of any kind are prohibited.  


IX. Conduct Policy

Don’t harass, intimidate or discriminate against other TOA Klub members.

Don’t publicly share any information about other TOA Klub members. 

Don’t promote illegal products or services on TOA Klub.

Don’t share any pornographic content on TOA Klub. 


X. Guarantee, liability, release

Legal rights of guarantee apply.

Tech Open GmbH is liable without limitations for premeditated or grossly negligent caused damages, malicious concealment of deficits as well as for damages on life, body or health.

In case of minor negligent caused damages Tech Open GmbH is only liable for damages regarding contractual obligations.

For a detailed list regarding Tech Open GmbH’s liability please refer to the German version of our T&C’s. 

XI. Place of execution, place of jurisdiction

Where the parties are general merchants [Vollkaufleute], jurisdiction and venue for disputes arising from or in connection with this contract shall be vested in the competent court located within the city where the Organiser has its registered office.

Should one or more provisions of these T&Cs be deemed invalid in whole or in part, this shall not affect the validity of the remaining provisions hereof.

XII. Extrajudicial settlement

The European Commission provides an internet platform for online dispute settlements (so-called “ODR platform”). The OS platform provides an extrajudicial settlement in case of disputes concerning contractual obligations after online purchase agreements. Allgemeine Geschäftsbedingungen für den TOA Klub Ticketverkauf der Tech Open GmbH

I. Geltungsbereich

Der Kauf und die Nutzung von Eintrittskarten (Tickets) richtet sich ausschließlich nach diesen Allgemeine Geschäftsbedingungen für den Ticketverkauf (Ticket-AGB) der Tech Open GmbH (im Folgenden “der Veranstalter”). 

II. Vertragspartner und Vertragsgegenstand

Vertragspartner ist die Tech Open GmbH, vertreten durch den Geschäftsführer Herrn Bernd Nikolas Woischnik, Prenzlauer Allee 242, 10405, Berlin.

Die Tickets berechtigen den Inhaber zum Zugang zum digitalen Lernprogramm TOA Klub für die Dauer des jeweiligen Programms. 

III. Verkauf, Zahlung und Versand

Der Ticketverkauf erfolgt ausschließlich über unsere Internetseite unter www.toaklub.com und ist in der Regel nur gegen Vorkasse möglich. Der Ticketverkauf über unsere Internetseite wird durch unseren Kooperationspartner Paperform, Law Squared Level 19, 114 William Street Melbourne VIC 3000 Australia, durchgeführt. Vertragspartner bleibt aber in jedem Fall die Tech Open GmbH (siehe Punkt Nr. II dieser AGB)

Wir bieten die Zahlungsarten Kreditkarte (Visa, Master Card, American Express), SEPA-Lastschrift und Sofortüberweisung an.

Tickets werden nach dem Onlinekauf ausschließlich per Mail an die im Bestellvorgang angegebene E-Mail-Adresse verschickt.

Die Ticketpreise sind Endpreise und verstehen sich in Euro, zuzüglich der gesetzlichen Mehrwertsteuer und etwaiger Gebühren des Ticket-Dienstleisters. Die Höhe der Ticketpreise richtet sich nach der jeweils geltenden Preisliste und wird beim Bestellvorgang, jedoch noch vor Vertragsschluss dem Käufer angezeigt. Der ausgewiesene Gesamtpreis ist sofort fällig.

IV. Pflichten der Kund*innen

Kund*innen müssen nach Erhalt der Tickets diese auf Richtigkeit in Bezug insbesondere auf Preis, Datum und Programm prüfen.

Reklamationen sind unverzüglich, spätestens jedoch nach 3 Werktagen nach Erhalt und Feststellung des Fehlers gegenüber der Tech Open GmbH geltend zu machen. Hierfür genügt die Mitteilung per E-Mail an hi@toaberlin.com oder per Post an Tech Open GmbH, Prenzlauer Allee 242, 10405, Berlin.

Die Tickets sind vor unbefugten Vervielfältigungen durch Dritte geschützt aufzubewahren. Bei Verlusten und/oder bei missbräuchlicher Verwendung der Tickets haben Kund*innen in diesem Zusammenhang keinen Anspruch Zutritt zum Programm oder Erstattung des Ticketpreises.

TOA Klub ist ein globales Lern- und Netzwerkprogramm, welches von den Namen der Teilnehmenden lebt. Dementsprechend behält sich der Veranstalter das Recht vor, die von Kund*innen angegebenen Informationen wie Namen und Arbeitgeber an Dritte weiterzugeben. 

V. Rückgabe und Erstattung von Tickets

Eine Rücknahme von Tickets und Rückerstattung des vollen Ticketpreises sind bis zu vier Wochen vor Programmstart ohne Angabe von Gründen möglich. Danach ist eine Rückerstattung ausgeschlossen, es sei denn das TOA Klub Programm wurde aus Gründen die die Tech Open GmbH zu vertreten hat verschoben oder abgesagt. 

VI. Weiterverkauf, Vertragsstrafe, Besuchsverbot, gesperrte Veranstaltungen

Tickets können nur zum persönlichen Gebrauch erworben werden. Der Erwerb zum Zweck eines gewinnbringenden Weiterverkaufs (kommerzielle Zwecke) ist verboten. 

Eine Übertragung des Tickets auf einen Dritten ist nicht möglich.

Kund*innen, die Tickets unter Verstoß gegen vorstehende Bestimmungen weitergeben, zahlen der Tech Open GmbH eine angemessene Vertragsstrafe pro vertragswidrig weitergegebenen Ticket. Die genaue Höhe der Vertragsstrafe wird durch die Tech Open GmbH im Einzelfall nach billigem Ermessen festgelegt und ist im Streitfall vom sachlich zuständigen Gericht auf ihre Angemessenheit hin zu überprüfen. Die Vertragsstrafe ist auf etwaige Schadensersatzansprüche der Tech Open GmbH wegen des Verstoßes anzurechnen. Die Tech Open GmbH behält sich die Geltendmachung weiterer zivil- und strafrechtlicher Ansprüche vor.

Bei Verstößen gegen vorstehende Verbote kann die Tech Open GmbH das betroffene Ticket sperren.

Die Tech Open GmbH behält sich das Recht vor, den Zutritt zur Veranstaltung aus wichtigem Grund zu verweigern. Als wichtiger Grund gilt insbesondere, aber nicht ausschließlich, ein Verstoß gegen die Verhaltensrichtlinien, ein offensichtlicher stark alkoholisierter Zustand oder unter Drogeneinfluss stehende Teilnehmer*innen. Verstöße gegen den Jugendschutz berechtigen gleichermaßen zur Verweigerung des Zutritts. Bei Vorliegen eines wichtigen Grundes verliert das Ticket seine Gültigkeit. Der Eintrittspreis wird nicht erstattet.

VII. Zutritt, Recht am eigenen Bild, gewerbliche Nutzung von Bildern

Die Teilnahme am Programm erfolgt auf eigene Gefahr.

Inhaber*innen eines Tickets willigen unwiderruflich in die unentgeltliche Verwendung ihrer Bilder und ihrer Stimme für Fotografien, Bildschirmaufnahmen, Live-Übertragungen, Sendungen und/oder Aufzeichnungen von Bild und/oder Ton, die von der Tech Open GmbH oder derer Beauftragten in Zusammenhang mit der Veranstaltung erstellt werden für alle gegenwärtigen und zukünftigen Medien ein.

Die gewerbliche Nutzung von selbst erstellten Bildern, die während des Programms aufgenommen wurden, bedarf in jedem Fall der Zustimmung der Tech Open GmbH.

VIII. Beachtung Urheberrechte

Der Kunde verpflichtet sich zur Beachtung bestehender Urheberrechte und verwandter Schutzrechte. Die von der Tech Open GmbH bereitgestellten Materialien, Unterlagen und sonstigen Inhalte dürfen nur für den persönlichen Gebrauch eingesetzt werden. Bild-und Tonaufnahmen jeder Art oder Screenshots der Veranstaltung und ihrer Inhalte sind nicht gestattet. Alle Video-,Ton-und Bildrechte liegen bei der Tech Open GmbH . Der Kunde stellt die Tech Open GmbH von Ansprüchen Dritter frei, die von diesen aufgrund der Nichtbeachtung der vorliegenden Vereinbarung geltend gemacht werden.

IX. Verhaltensrichtlinien

Andere Teilnehmende des Programms dürfen nicht belästigt, gemobbt, bedroht oder diskriminiert werden. 

Informationen über andere Teilnehmende des Programms dürfen nicht öffentlich geteilt werden. 

Im Rahmen des Programms dürfen keine illegalen Produkte oder Dienstleistungen beworben werden. 

Im Rahmen des Programms dürfen keine pornografischen Inhalte geteilt werden. 

X. Gewährleistung, Haftung, Freistellung

Es gelten die gesetzliche Gewährleistungsrechte.

Die Tech Open GmbH haftet in jedem Fall unbeschränkt, für vorsätzlich oder grob fahrlässig verursachte Schäden, bei arglistigem Verschweigen von Mängeln, sowie für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Auch die Haftung für Schäden aus der Verletzung einer Garantie ist unbeschränkt.

Bei Verletzung wesentlicher Vertragspflichten (sog. Kardinalpflichten), die nur auf einfacher Fahrlässigkeit beruht, haftet die Tech Open GmbH beschränkt auf den Ersatz des vorhersehbaren, vertragstypischen Schadens.

Außer in den eben genannten Fällen haftet die Tech Open GmbH nicht für Schäden, die durch einfache Fahrlässigkeit verursacht wurden.

Das Recht der Kund*innen, sich wegen einer nicht vom Veranstalter oder der Tech Open GmbH zu vertretenden, nicht in einem Mangel bestehenden Pflichtverletzung vom Vertrag zu lösen, ist ausgeschlossen.

Soweit die Haftung der Tech Open GmbH nach den vorstehenden Absätzen ausgeschlossen oder beschränkt ist, gilt dies auch für die Haftung ihrer Erfüllungs- und Verrichtungsgehilfen.

Macht ein Dritter gegenüber der Tech Open GmbH Ansprüche wegen der Verletzung von Schutzrechten durch den Besucher geltend, ersetzt der Besucher der Tech Open GmbH alle in diesem Zusammenhang entstandenen notwendigen Verteidigungskosten und sonstigen Schäden, soweit der Tech Open GmbH aus Rechtsgründen die geeigneten Abwehrmaßnahmen und Vergleichsverhandlungen vorbehalten bleiben bzw. bleiben müssen. Der Besucher hat in diesem Fall der Tech Open GmbH einen Vorschuss in Höhe der geschätzten Verteidigungskosten zu zahlen.

XI. Erfüllungsort, Gerichtsstand

Ist der Kunde Kaufmann im Sinne des HGB, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, so ist der ausschließliche Gerichtsstand für alle Auseinandersetzungen aus und im Zusammenhang mit dem Vertragsverhältnis sowie der Erfüllungsort für Zahlung, Lieferung und Leistung Berlin. Dies gilt auch, wenn der Kunde in Deutschland keinen allgemeinen Gerichtsstand hat oder, wenn er seinen Wohnsitz oder gewöhnlichen Aufenthalt nach Vertragsschluss an einen Ort außerhalb Deutschlands verlegt oder wenn dessen Wohnsitz oder Aufenthaltsort zum Zeitpunkt der Klageerhebung nicht bekannt ist. Die Tech Open GmbH ist jedoch berechtigt, auch am Sitz des Kunden zu klagen.

XII. Streitbeilegung

Zur außergerichtlichen Beilegung von verbraucherrechtlichen Streitigkeiten hat die Europäische Kommission eine Online-Plattform eingerichtet, die unter: http://ec.europa.eu/consumers/odr erreicht werden kann.

Die Tech Open GmbH kann per e-Mail unter hi@toaberlin.com erreicht werden.

Die Tech Open GmbH ist nicht bereit oder verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

Nach Entstehen einer Streitigkeit zwischen der Tech Open GmbH und einem Verbraucher-Kunden, die nicht durch Verhandlungen mit dem Verbraucher-Kunden, zum Beispiel im Rahmen unseres Kundenbeschwerdesystems beigelegt werden konnte, können Verbraucher-Kunden grundsätzlich die für allgemeine Verbraucherprobleme zuständige Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e. V. kontaktieren.

When visiting the website

You can visit our website www.toa.berlin without disclosing information regarding your identity. In the context of any access to our website, however, it is essential that certain personal data is stored on the server of our provider in order to enable the connection to the website. This includes information such as:

  • Client IP address,
  • Date and time of access,
  • Name and the URL of the file requested,
  • Referrer-URL,
  • Operating system of the requesting computer,
  • Name and the description of the internet browser you are using,

The information is processed for technical and administrative purposes

The information is stored in a so-called log file on the server of our website and is automatically deleted there after 4 weeks.

The legal basis for processing the IP address and other information from the log file is Article 6 para.1 S.1 lit. f of the GDPR. Our legitimate interest arises from the security interest mentioned and the need for a trouble free and user-friendly provision of our website. From the processing of the IP address and other information in the log file, we can not draw any direct conclusions about your identity.

In addition, we use cookies and analysis services when visiting our website. Further details can be found in sections 4 and 5 of this privacy policy.

When applying for a programme or submitting another online form with personal information

When applying to participate in a Klub/programme or filling out another online form with personal information (e.g. recommending someone for Klub), we will collect your name, email and LinkedIn profile. In addition to planning purposes, the processing of this data primarily serves to carry out the programme itself and to be able to inform you about the steps of your application or recommendation process as well as any other updates about TOA, Klub and our other products that might be relevant for you. 

The processing is in accordance with Article 6 para. 1 subpar. 1 lit. b GDPR necessary for the performance of a contract with you and in order to take steps at your request prior to entering into a contract and is necessary on the basis of our legitimate interests for the aforementioned purposes, Art. 6 para. 1 subpar. 1 1 lit. f GDPR.


Disclosure of personal information

Except in the aforementioned cases of processing on behalf of us, we shall disclose your personal data to third parties only in the following cases:

Web hosting

Our website is hosted by Webflow, Inc. (hereinafter “Webflow”)

Based on Art. 6 Subs. 1 Sentence 1 lit. f GDPR and due to our legitimate economic interest to run this website Webflow processes on our behalf data in connection with the use of this website. In a data processing agreement we have with Webflow, Weflow assures to be GDPR-compliant and to protect the data subject’s rights. Webflow is a US-based company so that the information is transmitted to and stored on a server in the USA based on EU Standard Contractual Clauses, we have entered with Webflow.

Other transfer

Otherwise, we shall only pass on your personal data to third parties if:

  • you have given your explicit consent pursuant to Article 6 Para. 1 S. 1 lit a of the GDPR;
  • pursuant to Article 6 para. 1 S. 1 lit. b of the GDPR necessary for the performance of a contract with you (e.g. when you apply to a workshop);  
  • pursuant to Article 6 para. 1 S. 1 lit. c of the GDPR necessary for compliance with a legal obligation.

The third party may only use the data transferred for pre-determined purposes.


Cookies and Pixel-Tags

We use cookies and pixel tags on our website. Cookies are small files that your browser automatically creates and are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not harm your device; do not contain viruses, Trojans or other malicious software.

Conversion tracking tools allow us to measure and analyse the effectiveness of certain measures on our website and on third-party platforms. We have a legitimate interest in making such measurements to target our customer communications. Google Analytics

Our website uses Google Analytics, a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as “Google”). Google uses cookies and in this context creates pseudonymous user-profiles.

The information generated by the cookies about the use of our website (e.g. IP address of the accessing computer, time of access, referrer URL and information on the browser and operating system used) are generally transferred to servers of Google in the USA and processed there. Google complies with the privacy regulations of the EU-US Privacy Shield and is registered with the US Department of Commerce’s Privacy Shield Program. Thus Google provides guarantees to comply with EU data protection law.

We use Google Analytics based on our legitimate interests (Art. 6 Para. 1 Sentence 1 lit. f DSGVO) in the analysis and optimisation of our online services and the economic operation of this website. Google therefore processes the information on our behalf in order to evaluate the use of the website, compile reports on website activity and provide us with other services relating to website activity and internet usage for market research purposes and to tailor this website to meet our needs.

We have entered into a processor agreement with Google for the use of Google Analytics. Through this agreement, Google assures that it processes the data in accordance with the General Data Protection Regulation and guarantees the protection of the rights of the data subject.

We Google Analytics exclusively with IP anonymization enabled. This means that Google shortens the IP address of users within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is transmitted to a Google server in the USA and shortened there. The IP address is, by no means, merged with other data held by Google.

We do not use the Universal Analytics with User ID offered by Google.

If necessary, the collected data will be transferred to third parties, if this is required by law or if third parties process the data on behalf of third parties.

The user data collected via cookies will be automatically deleted after 14 months.

You can prevent the installation of cookies by setting the browser software accordingly. However, we would like to point out that in this case not all functions of this website can be used fully.

You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on.

Google Ads

On our website we use Google Ads (Conversion Tracking and Remarketing) of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as “Google”). The service enables us to design, statistically record, optimize and display advertising content according to our needs. In order to ensure the visibility of our offer, we are dependent on such advertising content. Google Ads places a cookie on your computer if you have accessed our website via a Google advertisement. These cookies lose their validity after 90 days. If you visit certain sections of our website and the cookie has not yet expired, Google may recognize that you have clicked on the ad and have been directed to that page.

In addition, we use remarketing pixels to collect and evaluate information about your use of our website. This enables us to address you on other websites with content relevant to you. According to Google, the data collected during remarketing is not merged with any personal data stored by Google. In addition, Google pseudonymises this data. Remarketing data based on tags are stored for 90 days.

The information generated by the cookie and pixel tag about your use of this website, such as click performance on texts and products or interactions with videos, are transmitted to a Google server in the USA and stored there. Google complies with the EU-US Privacy Shield regulations and is registered with the US Department of Commerce’s “US Privacy Shield” program.

Each ads customer receives a different cookie. As a result, cookies cannot be traced beyond the respective ads customer websites. The information collected using the conversion cookie is used to generate conversion statistics for ads customers who have opted for conversion tracking. As an ads customer, we see the total number of users who have clicked on an ad and been directed to a site with a conversion tracking tag. However, we do not receive any information that personally identifies you.

If you do not wish to participate in the tracking method, you can also decline to set a cookie as required for this – for example, by setting your browser to disable the automatic setting of cookies. Google Tag Manager

Our website uses the Google Tag Manager tool from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). The Tag Manager tool itself (which implements the tags) is a cookie-free domain. The tool however, triggers other tags that may collect data. Google Tag Manager does not access this data. We use the marketing services “LinkedIn Ads” and “LinkedIn Analytics” of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (hereinafter “Linkedin”). The service enables us to obtain statistical information about visitors to our website. This enables us to tailor and place our content and advertising to meet your needs. The processing is carried out on our behalf, based on a data processing agreement we have with Pipedrive. Twitter Conversion Tracking

This website uses the Twitter online advertising program “Conversion Tracking” and the associated pixel tag technology from Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA (hereinafter “Twitter”). This allows us to track your user behaviour when you have viewed or interacted with ads on Twitter.  This gives us a better overview of how successful our campaigns on Twitter are and enables us to continually optimize these campaigns.

The pixel tag is loaded to or from your device when you respond to an ad we place on Twitter, for example by clicking a link to our website. In this context, a pixel ID is created and stored in a cookie so that we can temporarily analyze your user behavior. The pixel tag is not used to identify you personally.

We use the pixel tag of Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (“Facebook”). Facebook Pixel allows us to see how you react to our Facebook ads, for example, when you click on a link in the ad that leads to our website. This gives us a better understanding of how successful our Facebook campaigns are and enables us to continually improve them. In this context, a pixel ID is created and stored in a cookie so that we can analyze your user behavior until the pixel count expires. The pixel tag is not used for personal identification.

Facebook Custom Audiences

This website also uses Facebook Custom Audiences from Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (“Facebook”). This is a Facebook marketing service that allows us to display personalized and targeted advertising on Facebook to certain groups of pseudonymous visitors to our website who also use Facebook.

Our website has an integrated Facebook Custom Audience pixel that stores personal information about the use of the website. This includes your IP address, the browser you are using, and the source and target pages. This information is transferred to Facebook servers in the United States. There it is automatically checked whether your browser has saved a Facebook cookie. The Facebook cookie automatically determines whether you belong to the target group relevant to us. If you belong to the target group, we will display corresponding ads on Facebook. During this process, you will not be personally identified by us or Facebook by comparing the data.

We use on our website components (videos) of the company YouTube, LLC 901 Cherry Ave, 94066 San Bruno, CA, USA (hereinafter: “YouTube”), a company of Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: “Google”), on the basis of our legitimate interests in accordance with Art. 6 para. 1 subpar.. 1 lit. f DSGVO to make our website more attractive for you.

We use the “enhanced privacy mode” option provided by YouTube to do so.

When you visit a page that has an embedded video, YouTube connects to the YouTube servers and displays the content on the website by notifying your browser.

According to YouTube, in “extended data protection mode”, your data – in particular the pages of our website you have visited and device-specific information including your IP address – will only be transmitted to the YouTube server in the USA when you watch the video. By clicking on the video, you consent to this transmission.  

If you are logged in to YouTube at the same time, this information will be assigned to your YouTube member account. You can prevent this by logging out of your account before you visit our website.

Information regarding your right to object pursuant to Article 21 of the GDPR

You have the right at any time, on grounds relating to your particular situation, to object and prevent the processing of personal data concerning you pursuant to Article 6 para. 1 lit. e of the GDPR (Data processing in the public interest) and Article 6 para. 1 lit. f of the GDPR (Data processing on the basis of a balance of interest); this also applies to profiling based on the provision of Article 4 para. 4 of the GDPR.

If you file an objection, we shall no longer process your data, unless we are able to provide proof of compelling and legitimate grounds for the processing that outweigh your interests, rights and freedoms, or the processing serves the purpose of exercising, enforcing or defending of legal rights.

Insofar as your objection is directed against the processing of data for direct marketing purposes, we shall stop processing immediately. In this case, the specification of a particular situation is not required. This also applies to profiling insofar as it is associated with such direct advertising.
